Rental Rules and Regulations:

  1. CHECK-IN TIME is after 5:00 PM EST and CHECK-OUT TIME is before 10:00 AM EST. “Check-out” means all guests, belongings, and vehicles are removed from the property by 10:00 AM EST. No early check-in or late check-out is permitted unless agreed to by the owner in writing. Please note: Cape San Blas is on EST. The CST zone starts in Mexico Beach (very close to CSB). Your cell phone may pick up towers in CST and show the incorrect time. Check-in and Check-out times are EST.
  2. ABSOLUTELY NO SMOKING: THIS IS A NON-SMOKING PROPERTY. Smoking is NOT permitted anywhere on the property. Evidence of smoking on the property will result in immediate eviction and forfeiture of all amounts paid and will result to Renter as Excess Damage Cost of $500.
  3. PETS: No pets are permitted on the property. Evidence of pets on the property will result in immediate eviction and forfeiture of all amounts paid and will result to Renter as Excess Damage Cost of $500.
  4. BOOKING FEE/RESERVATION DEPOSIT and signed Rental Agreement: A 50% booking fee/reservation deposit is required at time of reservation. The reservation can be cancelled for a 96% refund up to 60 days before the rental period. The reservation can be cancelled for a 50% refund up to 30 days before the rental period. Under 30 before the rental period will not provide any refunds to the booking fee/reservation deposit.
  5. DAMAGE DEPOSIT HOLD: We will not collect an upfront damage deposit however, a hold of $1000 will be placed on your provided credit card on the day of your arrival. It is fully released within 2 days of departure (check-out) provided the property is left in a reasonably clean condition according to check-out instructions and all the conditions in this agreement are met, including but not limited to:
    1. No damage is done to the unit or its contents, beyond normal wear and tear that is reported to us prior to check-out. Any item damaged to the point of needing replacement will result in a charge to renter and deduction from deposit in the full value of the item.
    2. No charges are incurred due to damage, late check-out (see above), pets ($250), smoking ($250)
    3. The renter is not evicted by the owner, agent or representative of law enforcement, a security company, or an employee of the owner or Sunset Pointe associated.
    4. No large parties or receptions are allowed
    5. No fireworks or other hazardous materials are allowed on the property or in the house.
    6. The house is inspected and inventoried before and after each occupancy. Damages/missing items will be deducted from $1000 damage hold. If damaged or missing items exceed the $1000, Renter(s) agree to pay such damages and any associated collection expenses upon receipt of damage notification.
    7. All Sunset Pointe Rules and Regulations that are posted MUST be followed.
    8. Renter(s) must STAY OFF OF THE DUNES and STAY OUT OF NATURAL SCRUB. This is Florida law and fines start at $500. This is for the preservation of natural habitat and wildlife as well as for your own safety. Owner(s) are not responsible for any injury associated with infraction of this term, nor are owner(s) responsible for any fee/charge assessed to renter(s) for infraction of this term.
    9. All beach chairs, coolers, tents, sand toys, kayaks, etc must be brought up from the beach each day after use. Leaving any items on the beach overnight is not allowed
    10. All beach chairs, coolers, tents, sand toys, kayaks, etc must be stored on the property each evening within the fenced/gated area or inside the carport. No items may be left out in the yard, grass, sand, dunes, beach, or any other areas.
    11. All check-out procedures are followed
    12. All furniture returned to its original location
    13. Outside pool area is left in order
  6. REPAIRS AND MAINTENANCE: Repairs and maintenance problems must be brought to the Manager’s attention within 24 hours of occurrence. Renter(s) will be held liable for any damage caused by known or unreported maintenance problems. Renter(s) is also liable for any damage and necessary repairs caused by Renter(s) and guests. Owner will not be responsible for any unauthorized expenses incurred by Renter(s) or his/her guests. Cost of needless or unauthorized expenses will be charged as Excess Damage Cost against the deposit and, if the damages exceeded the deposit amount, the guest agrees to promptly pay the difference.
  7. HURRICANE/STORM: No refunds will be made for inclement weather, hurricanes, or storms. Trip cancellation insurance is available to the Renter(s) to purchase through various agencies and obtaining such is left to the Renter(s) discretion. If the Renter(s) has any concerns about situations that might impact the Renter(s) vacation schedule, the Renter(s) may want to consider travel insurance for the trip.
  8. EXCEPTIONS:
    1. If there is a forced evacuation during Renter(s) week a prorated amount will be refunded for nights not utilized
    2. If travel to the Cape is banned by governmental authorities for any reason prior to your scheduled arrival, you are entitled to receive a full refund.
  9. MAXIMUM OCCUPANCY: The total maximum number of daytime and overnight guests allowed at the home is eighteen (18). This includes adults, children, and infants. The Renter signing the agreement must be 25 years of age and will be held responsible for all other parties and/or guests of the Renter(s) for compliance with this Agreement, with listed policies, ordinances, rules and regulations and for losses incurred by Manager due to negligence or vandalism. We do not rent to anyone under 25 years of age unless accompanied by an adult guardian or parent who is the responsible party. We reserve the right to refuse rental or discontinue occupancy if, in our judgement, occupancy is detrimental to the property or neighbors or is different from what was represented.
  10. VEHICLES, MAXIMUM ALLOWED: PARKING CARS AND TRAILERS: The maximum number of vehicles allowed at the property at any time is five (5). This includes cars and trailers (e.g. boat trailers). A car and trailer are considered two (2) vehicles. All vehicles for all guests must be parked under the house or in the driveway. No vehicles can be parked along the street, in the street, on vacant property, or in landscaped areas. If parking occurs in non-designated areas Guest will incur a $100 charge per day, per vehicle until the vehicle is moved or towed. HOA enforces the following parking rules:
    1. Campers, RV's, Motor homes and/or Buses may not be parked in the subdivision.
    2. Boats and trailers must be parked only on the driveways or in the garages of the home, not on yard areas or easements.
    3. Renters may only park in the driveways of the home they are leasing.
    4. No one is permitted to park in yards or on streets or easement areas.
  11. NO HOUSE PARTIES OR LARGE GROUPS: In the event the home is booked for a large group gathering without our knowledge renter and guests will be asked to vacate the premises immediately with no refund. Without expressly written prior approval, our home may not be used as gathering places for family reunions, weddings, parties, where the number of people at the home day or night exceeds the home’s maximum occupancy capacity (16). Large social gatherings of this nature will result in the immediate eviction and forfeiture of all payments including the damage deposit.
  12. TRASH: Please bag and tie all trash.  BCC Wastes Solutions conducts trash pickup. We have curb service, so BCC will come get the cans from the carport on the designated trash days. Do not leave trash on the ground at any time (even if it is in bags) and please ensure the trash can lids are closed. 
  13. LINENS AND CLEANING SUPPLIES: For your convenience, all beds are made. A set of towels is provided for each guest as well as an initial supply of toilet paper, tissues and paper towels (specific items will be listed in the Welcome Documents, sent prior to check-in and is also available upon request). There is no daily maid service during the reservation period. Cleaning supplies, including a broom, dustpan, mop, vacuum cleaner, washer and dryer are all available in the unit. All cleaning supplies should be returned to these locations after use. Cleaning supplies are hazardous to children and pets. It is the Renter(s) responsibility to use and store cleaning supplies safely. Renters should bring or purchase additional toilet paper, paper towels and garbage bags. Bed linens and bath towels should not be removed from the house for any reason.
  14. OUTDOOR SHOWER: There is a large outdoor shower and hose provided under the house for you to rinse off after being in the sand and on the beach. Please utilize this shower to keep excess sand and dirt out of the house.
  15. APPLIANCE AND UTILITY FAILURE: No refunds will be given for appliance or utility failure. We will make every effort to remedy any problems that may arise in as timely of a manner as possible. You can expect prompt attention to resolving issues. Please make every effort on your part to remedy the situation. Unusual and unnecessary service calls will be billed to the Renter(s).
  16. LIABILITY (POOL): The Renter(s) and their Guest(s) have access to a private pool located at the property. There is no lifeguard on duty and swimming is at the Renter(s) and their Guest(s) own risk. By renting the house, the Renter(s) agree to assume liability for personal injury, personal loss and property damage caused by the Renter(s) and their Guest(s) during the rental period. NO FURNITURE (INCLUDING BEACH CHAIRS) IS PERMITTED IN THE POOL. THERE IS ABSOLUTELY NO DIVING ALLOWED IN THE POOL, AND NO DIVING OR JUMPING OFF BALCONIES INTO THE POOL IS ALLOWED.
  17. LIABILITY (KAYAKS and other recreational equipment): The Renter(s) and their Guest(s) have access to sea kayaks and life vests located at the property, and possibly other items (bikes, beach chairs). Use of kayaks or any other recreational equipment is at the Renter’s (s’) and Guest’s (s’) own risk. By renting the house, the Renter(s) agree to assume liability for personal injury, personal loss, and property damage caused by the Renter(s) and their Guest(s) during the rental period. No dogs are permitted in the kayaks or other recreational equipment. An adult must accompany any minor while kayaking and life vests should be worn by all users.
  18. ACCESS TO THE HOUSE: Renter(s) authorize the owner(s)/agents(s) personnel access to the house to verify that all terms of this agreement are complied with and to do necessary maintenance. You will be provided an entry code, which will open the front door Smart lock. This code can be used to access the home during your rental period. A key lock box is located inside the outdoor shower if the code malfunctions. Your Welcome documents, sent prior to check-in, will contain your entry code.
  19. SUNSCREEN: Spray sunscreen should not be applied/used inside the home on any level at any time, as this causes damage and creates slipping hazards. Spray sunscreen should not be applied while sitting on outdoor furniture.
  20. PLUMBING: Guests will not pour grease down the sink. Guests will only flush toilet paper down toilets. Guests will not flush sanitary products down toilets. Guests will notify owner immediately with any plumbing issues that cannot be resolved by guest using plungers provided.
  21. INDEMNIFICATION AND HOLD HARMLESS: Renter(s) agree to indemnify and hold harmless The Barracuda, Gaslight Getaways and/or the owners of the Property against all loss, damage, expense and penalty arising from any action of the Renter(s), Guests of Renter(s) brought by either Renter(s) or their guests which causes injury or death to any person or damage to any property. Renter(s) is encouraged to secure the appropriate travel or vacation insurance and/or renter’s insurance.
  22. ATTORNEY’S FEES AND COSTS: If Owner/Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, to enact the evictions of the Renter(s) and/or Guest of the Renter(s), or to take any action to recover deposits not due, the Renter(s) shall be liable to Owner/Manager for reasonable attorney’s fees and cost incurred by Owner/Manager.
  23. ACCESS TO PROPERTY FOR SHOWING: If property is placed on the market for sale, Renter(s) agree to allow the property to be shown to prospective buyer(s) upon reasonable notice to Renter(s).
  24. SHORT-TERM RENTAL: It is expressly understood and agreed that this is a short-term vacation rental under provisions of Chapter 509., Florida Statutes, and is not a lease or other long-term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Renter(s), or Guest(s) and no right to renewal for recurring usage.
  25. UNAVAILABILITY OF PROPERTY: In the event that we determine that the rental is unavailable, sold or uninhabitable for your scheduled vacation, due to maintenance or other unforeseen problems, you are entitled to receive a full refund and we will make every effort to assist you in locating another property. If there is a State of Florida or city/county ban on short-term rentals for any reason, or traveler is denied access to the area/region due to natural disaster or other governmental ban within two weeks of your check-in date Renter(s) will receive a full refund of all monies paid.
  26. FALSIFIED RESERVATIONS: Any reservation obtained by providing fraudulent information will be subject to forfeiture of advance payment and deposit money and the party will not be permitted to check in.
  27. ADVERTISING: Every effort has been made for accuracy in our advertising, including our website and Facebook page: however, we are not responsible for errors or omissions. Rental data is subject to change without notice. Rental terms and conditions are subject to change without notice.
  28. GENERAL TERMS: This Agreement is made in, and shall be governed solely by, the laws of the State of Florida and Chapter 509, Florida Statutes. Venue for enforcement shall be Gulf County Florida. If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all remain in force and in effect. This Agreement is taken in full compliance with federal, state, and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
  29. EXCESS NOISE AND ROWDY BEHAVIOR: Renter(s) are to be mindful that this Property is in a residential neighborhood. Renter(s) are expected to be courteous to residents and guests, to be respectful of the rights of others and not to be noisy or obtrusive.
